Title I - Expand the Definition of Lobbyist

Summary:

To stop stealth lobbying and ensure that all “non-lobbyist lobbyists” report their activities, the definition of lobbyist is amended to remove the 20 percent exemption. Lobbyists must report all significant contacts and all activities in support such of such contacts. A “significant contact” is an oral, written or electronic communication to a covered executive branch or legislative branch official made to influence an official.

Sec. 101. Definition of Lobbyist

  1. LOBBYIST— The term ‘lobbyist’ means any individual who is employed or retained by a client for financial or other compensation for services that include more than one lobbying contact. Any former covered legislative or executive branch official as defined in the Lobbying Disclosure Act above who is retained by a client for financial or other compensation for services that include more than one lobbying contact shall be considered a lobbyist.

Sec. 102. Definition of Lobbying Contact

LOBBYING CONTACT — The term ‘lobbying contact’ means any oral or written communication (including electronic communication) that is made by a private party to a covered executive branch official or a covered legislative branch official in which such private party seeks to influence official action by any officer or employee of the executive or legislative branch of the United States including:

  1. The formulation, modification or adoption of Federal legislation (including legislative proposals);

  2. The formulation, modification, or adoption of a Federal rule, regulation, Executive order, or any other program, policy, or position of the United States Government;

  3. The administration or execution of a Federal program or policy (including the negotiation, award, or administration of a Federal contract, grant, loan, permit or license); or

  4. The nomination or confirmation of a person for a position subject to confirmation by the Senate.

Sec. 103. Definition of Lobbying Activities

  1. LOBBYING ACTIVITIES — The term ‘lobbying activities’ means lobbying contacts and efforts in support of such contacts, including preparation and planning activities, research and other background work that is intended at the time it is performed, for use in contacts, and coordination with the lobbying activities of others.
